nerve damage

my dr. says thoracic nerve damage may be beyond repair(2.0 is the extreme&mine is 1.6)he wants to try PT for about 6mos. asked IME dr.why none of the numerous drs. had done a nerve test but did all others(chxrays,mris,ct scans bone scans,mylogram) he said it wouldnt be prudent.now that an EMG has been done and damage was discovered,do i have any recourse against the drs. who sent me back to work and told me it would go away?

If an IME doctor (who examines you at the request of your Workers' Comp Insurance Carrier) malpractices upon you, your only recourse is continued receipt of workers' comp wage indemnification payments.

If the breaching doctors were your own physicians, however, then they may be properly sued for medical malpractice.
