Legal Question in Workers Comp in Pennsylvania

pain and suffering

in process of settling w/c case,information i recieved is that u can not claim pain and suffering on a w/comp. settlement. Is this the truth? also won't give me more then three years on medical after settlement, is this fair?

It is absolutely true that pain and suffering IS NOT recoverable in a workers' comp case in PA. As to whether or not they will remain responsible for medical expenses is usually a matter of negotiation. For example, the settlement may be for more money if the medical is included. On the other hand, it is notunusual for a WC insurance co. to want to close the entire file, and will only offer t settle if the medical is included in the settlement.
