Legal Question in Workers Comp in Pennsylvania

what are my rights

I have had back problems due to work at my current job for alittle over 4 years. Over this time frame I have been in and out of their treatment facitity with little or no help. Once again they are trying to push me back in to light duty or full duty with not ever solving the problem someone had a nurse call me and set up a IME I am unsure if it was my employer or their insurance company inservco or my attorney. The only thing that keeps getting repeated to me over and over is this is a new claim we dont work off of old claims example like a 2005 back injury. I dont really understand this and want to know why? I am still in pain and have many issues with my health I guess I want to know how they are covered if they are or are they just telling me a story and trying to get me back at little or no cost to them.

Your questions raisesd many issues. If you suffer a recurrence of an old injury, it is considered the "old claim". However, if you suffer an aggravation of a new injury, it is considered a new injury. There are several issues that can affect whether you want it treated as a recurrence or an aggravation.
