Legal Question in Workers Comp in Pennsylvania

settlement

My husband as sustained an injury and has been collection workers compensation for about 3 months now. He has had surgery and sustained permanent spine and nerve damage, which has yet to be determined. The adjuster suggested that we settle. He stated that he would put together a dollar amount and send us paperwork. What amount should we be expecting? My husband is 43 yrs. old and can no longer work.

You avbsolutely should not try to do this without counsel. You also need to find out if the doctor.made a mistake.

I am certain that you are being "low-balled". You absolutely should not be settling your case at this point. Settlements in workers compensation are based on the cost of future exposure to wage loss and medical expenses. Please contact my office to discuss further before proceeding.

You should not try to do this yourself. You are dealing with a highly trained insurance claims rep. You will likely not get the appropriate value if you do this yourself. You should contact an experienced worker's comp attorney to help you. Attorney's take these cases on a percentage fee basis so if there is no settlement you will pay no attorney fee. I'm very suspicious because comp insurer's generally do not consider a settlement so soon after an injury. I have been handling cases like this for over 25 years.
