i have a low back injury from hert on the job 2008 , 2 buldge discs 1 is rupture , something called anular tare, nerve dammage , constant pain in back and left legs , ware a back brace, hade 4 series of shots in spine , go to chiropractor 3 times a week , seen a nuro surgen said come back in 6 months if no change then surgery might be option ? have a lawyer because at first they were not paying all bills , but he dont seem to talk to me about a settlement ? when they usually accure, how much to expect , how its figured, he just blowes off the questions saying lets cross that bridge when we come to it ! well that dont help me figure out my future . i am 40 now ! work fired me after 6 months out said company policy . i aplied for dissability , was denied so lawyer is going to try to fight it ... live in north east pennsylvania ! jimmy

Jimmy,

you have a strong case by virtue of the rupture and annular tear. To my point of view, every rupture must involve annular tearing, but differences exist even in commonly used words. It means that some MRI or other test showed a pretty clear picture of damage.

It sounds like you are in payment status with weekly checks flowing. Thank your lucky stars as some people have to fight Claim Petitions rather than try to coax Settlements by whatever name they are being called post-Act 57.

Stay with your Claimants' Counsel so long as this ain't her, "First Rodeo." You might want to ask your existing lawyer if the Shick Lumber case applies to your wrongful discharge or if they make a referral on separate and distinct legal matters.
