Legal Question in Workers Comp in Pennsylvania

I have sole legal custody of my 2 granddaughters .. their father pased away in 2002 ,, their mother has recieved workmanscomp since then .. how do i stop her from getting it and have it go to the children,, their mother has been determined not to be financially responsible for these children because she cannot work and is waiting for ssi

Normally in a WC death claim, the amount of the payment to the surviving spouse and any minor children is determined by statute, with the spouse getting a certain amount and the children getting a certain amount. You should consult a workers compensation lawyer, and he may be able to file a Petition to modify the amount of WC benefits the mother is receiving and cause some of those benefits to go to the children.
