Legal Question in Workers Comp in Pennsylvania
workers comp
I was injured at work on 7/14/08.I had torn cartilage and my bone needed grinded. I had surgery on my wrist 10/27/08 and was off work for a total of 4 mo. 3 months before surgery and 5 weeks after. It has been 5 weeks since my surgery and I am no better than I was before. The dr. is sending me back to work on light duty and for pt/ot.What happens if I feel I can not work at all because of constant pain. I feel nothing was fixed and the pain is worse now. The dr. feels I just have issues with my scar. What should I do or can I do?

Re: workers comp
sounds to me like your doc has been paid, and has extracted his money from the insurance company and now feels a greater allegiance to it than to you: his or her patient.
reimind your doc about the functional overlay, pain and stiffness you have reported before and that it has not gone away. do not sound accusatory that there is a bad medical result. u r happy with the doc's services.
tell him the problems you are having with daily activities such as brushing teeth and other mundane tasks where you have noticed pain. ask him if pain itself can be disabling. be sure to have whatever limitations exists spelled out on a prescription slip of some sort over his signature.
get a second opinion.
hire experienced workers' comp counsel. if u r near harrisburg, see if tom cook, burke McLemore or stanley siegel is able to take the case. I am in Altoona.
Good Luck
