Hi, I got hurt at work in jan. 2007 was on w.c. for 2 months.. they took me off w.c. and have me on medical only...I got a lawyer ,he filed appeal, we had 1st. hearing...the appeal was for cash..judge asked my lawyer if he was gonna get a depo.from my dr. he said yes, next the judge asked the other lawyer if he was gonna get a I M EXAM on me he said yes he is..well yesterday I got the notice for this NEW DR. why am I gonna go to him?? Isnt he for them?? Remember I am not getting any cash from w.c. .so why am I gonna go see dr...I have a sprain cervical neck, closed head injury lots of other problems..my next court date is like in OCT 07...WHY SO LONG THANK YOU

In answer to your first question the insurance company has the right to have you examined by a doctor of their choosing under the workers' compensation statute. In answer to your second question, yes he will be very much for them. In answer to your third question, if you want to claim further cash benefits or settle the claim you have to make your claim under the workers' compensation laws as they exist. If you don't want any further benefits and aren't looking for any settlement, then why are you in the system? Finally, the reason for the delay in workers' compensation cases is to provide time for examinations and to schedule doctor's depositions. Don't blame your attorney, blame the legislature and the insurance companies.
