Legal Question in Workers Comp in Pennsylvania

Workers' Compensation Payment Question?

I have been on light duty post surgery due to a work related injury. It has been established that I am on the regular payroll for my straight 37.5 hour work week. I am to be compensated a percentage of my highest quarter for overtime on a weekly basis. Am I right to assume I should be getting those payments regularly since I am entitled to them? I recieved payment for retro back to my surgery date (9-22-08) and 1 check for 1 week of overtime compensation.I have not recieved any other payment for 2 weeks. Do I have a right to complain about not receiving the past due payment or can they send them to me whenever they please?

Re: Workers' Compensation Payment Question?

Under Section 306 of the Act, you have the right to be paid Workers' Comp wage indemnification benefits on the same day as your regular payday. Call Counsel if you have a problem.

In Harrisburg I recommend Thom Cook, in Phila George Martin. In Pgh, tell Shelley Elovitz I recommended you.

I am in Altoona.

Good Luck
