Legal Question in Workers Comp in Pennsylvania

workers compsettlement

I was given a settlement by employers Ins.Co. - they rushed it wanted to close their cases out - were no longer Ins. carrier for employer.

A little less than 2 yrs later employer requested I return to my previous job if capable - their Doctor released me for work with them

Disgruntled persons say I have to pay my employer back the settlemnt money the Ins.Co. gave me ?

If the settlement you entered into was what we call a Compromise and Release (C&R) Agreement, & you received a lump sum payment, & you are no longer receiving weekly or other regular wage loss payments, you can take whatever job you want without being required to pay back the settlement money. You can take a job from your old employer or a new employer. If you can get a job that you want take it.

better to return to the previous employer at a position titled differently with some different job duties. if you had a commutation, which is the way things used to be done, there would be a supplemental agreement indicating 500 weeks of partial disability. you probably did not commute, since the law was effectively gutted by gov ridge and the republicans by Act 57. therefore, if u only have a C&R, what's to stop you. tell your friends to get gruntled.
