Legal Question in Workers Comp in Pennsylvania

workman's comp pay

1was injured on the job when i was a part time nurses aide. and also attending college. i am now an rn with the same hosp. ihave found out i will need surgery to repair the injury. iwas informed by my employer that the compensation calculation would be using my part time wages. the wage difference is a conciderable difference. is this correct for the calculation?

I think this may be the same question I answered But I'll answer again. It depends on a determination by a Workers' Compensation Judge if you do not agree with the amount that the Insurance Company wants to pay. If you disagree with their calculation, then you need to file a Petition. When you file your Petition the insurance company will have to file a wage calculation document which will show your wages up to the date that you had the re-injury, if this is the same question. Because of this, I think you have a good chance of winning and it is probably your only option anyway.

If this is not the same question and there was only one injury, then a workers' compensation judge may side with the insurance company.
