Legal Question in Workers Comp in Pennsylvania
workman's compensation
I just was diagnosed with arthritis of the spine. I am a dental assistant and I stand all day long for hours at a time without breaks. My boss wants to let me go because I cannot run around or stand anymore like she needs me to. Should I file for workmans compensation?

Re: workman's compensation
If you can perform the essential job functions seated, you would have an ADA case so long as your employer fits the statutory definition.
You may have a tough workers' comp case as it is a hard sell to prove that the arthritis arose out of your employment and is related thereto.
