Legal Question in Workers Comp in Pennsylvania

Workman's compensation

My husband had two surgeries last year. They were for severe anal fistuals. We were told by two different dr. That was work related. The third dr. Who performed the surgery states not work related so he could not recv. Workman's comp. He now has some complications from the last surgery which was 8 months ago and is still driving truck-- is there a way he can prove work related and recv. Workman's comp. If time is needed off again?

In these types of cases the workers comp judge (WCJ) relies on the medical expert's opinion on whether or not an injury is work related. Here you have conflicting opinions. Do you know why the 2 docs stated the injury was related? Do you know why the surgeon said not related? The WCJ will determine which opinion is more likely accurate. You will need to consult with an experienced worker's comp atty, who can review the records, & decide if taking the case to a WCJ is worthwhile.
