Legal Question in Criminal Law in Philippines
for qualified theft, do they issue a warrant of arrest right away after the complainant filed the case?

For criminal cases, warrants of arrest are not issued automatically after the complainant filed the case before the prosecutor. The prosecutor shall set the case for preliminary investigation where the respondent will be given a chance to submit counter-affidavit and controverting evidence. In the event that the prosecutor found probabel cause to hold respondent for trial and filed a criminal case in court, the court shall then issue a warrant of arrest.
