Legal Question in Civil Rights Law in Philippines
we filed a forgery/civil case against a pawnshop owner who falsified a Deed of Sale between them and our parents. This is actually a counter case from our end since they instigated a case against us for non-payment of interest and for the supposed "fraudulent deed of sale". the case has been in motion for over a decade, and there's a possibility it will reach the Supreme Court, despite of the confirmed evidences against our opponent, our legal counsel advised us that we should settle. our evidences are.. forgery of my parents' signatures, falsified document proof of which.. antedating the signature of my father..they made it to appear that our father signed the doc when in fact the date when he signed it, he already passed away., perjury, they swore that my parents were around during the signing of the falsified doc, when in fact my father was already bed-ridden then
,they presented a fabricated MOA , tax account number was fabricated, too..
Our question, What is the weight of our contention here, being that, we do not want to settle the loaned money and the interest , versus the weight of their deceit against us. Will the law favor us with the contention that we havE?
1 Answer from Attorneys
if you can prove that your father's signature was falsified and they presented fabricated documents then you have a good case.
