Legal Question in Civil Rights Law in Philippines
rights of legal wife and children
I want to be separated to my abusive husband who is a seaman. But I want to ensure the future of our 2 kids aging 5 and 1. Although I received the 80% allotment but when he comes home he wants me to account every cent of his money in all the expenses that I have made. I'm an accounting graduate, & a govt. employee w/ an income of my own so i don't/ never totally depend all my personal needs from his income. But inspite of that he even wants me to account my own income?! Fortunately I made a monthly record of all the expenses I made out of his money with O.Rs. He has some investments, accountabilities, loans among others. Kids got hospitalized, I had a CS and when he comes home he was freaking mad that his income computations didnt match w/ my passbook. i explained to him everything based on the records I kept but he was deaf and blind he looks so scary...Can I demand for an 80% allotment still as support for his kids even if we are already separated, without him questioning it? Can I file a case against him for violation of RA 9262-Psychological abuse? Or what other violation can I file against him?Are my kids & I entitled to all his property? Thanks.

Re: rights of legal wife and children
Yes you can initiate a complaint fo violation of this RA 9262 against your husband and pray for a protection order. If you are only separated in fact with your husband you and your children are still entitled to support. I suggest you try to work out the marriage by convincing your husband to submit for a marriage counselling and if things did not work out then you can resort to a legal action.
