Legal Question in Construction Law in Philippines
My condo in Manila was turned over to me last December 2011 and 3 months after we noticed some cracks on our wall and made water seep through our unit. The Property Management office were formally and officially informed about it and they came 3 times to repair but it is still cracking and water still seeps through our walls towards inside the unit. My fear that this structural defect will escalate more and more and the warranty of my unit is already finished. Can I returned my unit to the developer for a refund. My unit was all fully furnished since February 2012 and it is not tenantable due to this severe issue water seeps 15 to 20 liters of water during medium to heavy rainfall. Can I hire an engineering firm to certify about this structurl defects? I would like to email you the photos.

You can initiate rescission of the contract with damages. Yes, by all means have it checked by a structural engineer to determine the extent of the defects..
