Legal Question in Credit and Debt Law in Philippines
my "friend" borrowed money last year about 10k php and he said it was for his family since he was being let go of his former employer, so i sent money to him but the recipient is on another's name and account number, he said he'd pay me but he didnt, i asked him to give me even a post-dated cheque just for assurance and he said he doesnt have any. i am working abroad and every money counts, so i asked him again and his wife asked what he owed me and i just copy paste all our conversations before and now he deviates the story that im ruining his family and he became hysterical because his wife found out that he borrowed money saying it was for her and his kid but actually she never receive any money from him. so now can i sue him for that? maybe estafa?

Hi,
I am sorry for your legal predicaments. I remember Polonius in Shakespeare's Hamlet giving fatherly advice to his son Laertes : Do not lend money to friends. A loan to a friend often results in the loss of both the money and the friendship.
Your legal remedy is to file a simple collection case at the Municipal Trial Court. But I do not know if an amount of P10,000.00 is worth the trouble and inconvenience since your are working abroad. Thank you for wiring.
