Legal Question in Credit and Debt Law in Philippines
I pawned my Dell XPS 14z laptop last December 29, 2012 for the amount of Php25,000.00 or $612.63 with a monthly interest of Php2,000.00 or $49.01 (But I only received Php23,000.00 or $563.58).
After sealing the laptop and signing the papers and pawn ticket the pawnshop staff placed my laptop inside their vault. The pawnshop owner and I agreed that I can just deposit my Monthly interest payment on his bank account since I live very far from the pawnshop which is a 4-5 hour drive.
January 2013 came and I deposited my 1st payment for the monthly interest. I informed the pawnshop owner via text message about my payment and he confirmed that he already received it.
February 2013, I deposited my 2nd monthly payment for the interest. After informing the pawnshop owner, I received a call from my mobile phone. It was the pawnshop owner. He told me that he and his pawnshop staff opened the seal (plastic seal with my signature) of my laptop and wiped or reformatted all my files because he forgot that I already paid the monthly interest. And he even brought my laptop from the pawnshop to his house. He offered me that he can waive the February interest payment for my laptop and I also agreed but until now I still feel violated because I signed and sealed my laptop and saw it being placed inside the vault. They opened it without my permisiion and all of my personal and business files were deleted.
Today it's March 25, 2013, I again informed the pawnshop owner that I will deposit my monthly interest payment for March. And I received a text message from his staff that my laptop is still not in the pawnshop's vault. My laptop is in the pawnshop owner's house and my laptop is not sealed!
What should I do besides going to the pawnshop and sealing my laptop again. I need help. Please? Thank you!
