Legal Question in Criminal Law in Philippines
is act of lasciviousness could be a person who is already on the right age or only for a child? Is kissing in the lips and embracing could be act of lasciviousness? my husband and daughters have close relationship. Kissing and embracing are normal with them even inside my room. but later on, the kissed of my husband at the lips and embraced to my daughter (23 yrs old) were considered act of lasciviousness. The incidence happened twice in year 2007 and we settled that problems within the family, controlling them not to kiss or embrace with each other. Year 2009 my daughter saw her daddy holding his penis while he was sitting in floor watching television with my daughter who at that time were at the back of her father watching tv also. My husband told me that there was problem in his sitting position so he adjusted his legs and penis and so i got angry with my husband and told him to separate with us. From Nov, 2009 up to May 2010 my husband is living with himself-no job and only supported by his poor brother for his food. My husband is not working for many years. he is our household maid and many times he was mistreated by my daughters especially during the period where my eldest and second from eldest were working. This month of May my husband was charge with act of lasciviousness by my daughter through great influenced by her auntie and grand father. My father and my sister did not want me to live with my husband even since year 2000; they want me to separate with him because he has no job. I am very much worried with my husband because he was being mistreated and his integrity being a father was already ruined. Is it possible that my husband will be jailed? I have no money to pay for the attorney. I already talked to my daughter not to continue the complaints but she still filed the case to provincial prosecutor. My husband already apologized with my daughter and yet she did not forgive my husband. Please tell me what to do. Subpoena was received by me today, may 4, 2011. thank you very much.
