Legal Question in Criminal Law in Philippines
my brother was detained since Aug. 26, 2009 he was a suspect for a stabbing incident happened in our neighborhood on the night of Aug. 26, 2009. No murder/pointed/deadly weapon found at the site, there is also no traces of blood on my brothers hands and shirts. One of the witness says that the victim might have slipped and caused a wound on his thigh, which he (the victim) claimed that my brother stabbed him twice. Our neighbor who happened to worked on the same hospital where the victim was brought says that the alleged stab wounds are not that deep and it looks to him that it's just a punctured wound. Police officers came and searched our housed a minute the incident happened. Now my brother is still in jail, and the complainant wants us to pay for the damages caused by the incident...I myself don't know what to do. Is it possible for my brother to be freed from prison? What are the necessary things or legal matters that we should take? please help us...my mother just got out from hospital confinement and my father had suffered a heart attack because of what happened. Please I'm appealing to anyone who could read this to please help us.

You better find out whether your brother has been charged either for attempted murder, homicide or physical injuries depending on the alleged circumstances of the crime. Then find out what court that the case is pending and the bail recommended. Then by all means bail him out either by surety or cash bail. You may also avail the services of the Public Attorney's Office (PAO) within your municiplaity or city and refer the case of your brother. Good luck to you.
