Legal Question in Criminal Law in Philippines

FACTS:
1. email is hacked and stolen and used to blackmail.
2. email is given to the police who make an arrest and detain owner of the email.
3. email owner gains release after 50 days of detainment, but is facing criminal charges.
QUESTIONS:
1. is the arrest illegal?
2. is stolen email useable in a court of law ?

These are questions which should be directed to the competent criminal defense counsel whom hopefully
this defendant already has on board by now to represent him in what appears to involve serious criminal charges (given the length of time the defendant has apparently already served in pretrial detention).
