Legal Question in Criminal Law in Philippines

Last sunday, September 28, 2012, I lost

my iPhone 4s inside our company. I placed

it inside my locker at around 5:59-6:01

pm. I went back to check on it at around

11:00-11:16 pm and that's when I learned

that my phone was missing. I immediately

reported it to the guards on duty and

asked if they can check on the CCTV

camera to see who opened my locker &

stole my phone. To my surprise, one of

the guards told me that they don't have a

CCTV camera designated on that particular

part of the building. Worst, they did not

conduct any search because according to

them it would be a violation of other

employees' rights, and that this is a

case of employee neglince which of

course, I totally disagree. I already

filed a police report last monday at was

able to talk to our employee relations

manager on the same who then I asked

about any updates regarding the said

incident. She told that it is still under

investigation and that she will just send

me an email for any updates. It has been

a week now but I haven't heard anything

from the them and I really intend to take

this case a step higher.

If you resort to elgal action this will cost you more than the value of your phone. You can sue for damages but how can you prove the fact that you put your phone on the locker when no one had seen it. This is one of the obstacle you will have to overcome. Good luck.
