Legal Question in Family Law in Philippines
Hi atty. how can i file for this:
"Through a Protection Order, the court will order the father and his employer to set aside a certain percentage of his salary to be remitted directly to the children on a monthly basis. If the father or his employer, or both fail to do so, they can be charged with contempt of court."
What are the 1st step/procedures i need to do in order for me to avail that said protection order "the court will order the father and his employer to set aside a certain percentage of his salary to be remitted directly to the children on a monthly basis".
I don't want to send any sms on my sons father every month just to remind him 1-2weeks before my son's examination & if my son needs immediate medical/hospitalization coz we always argue and sooooo much emotional stress on my part and my hatred to him grows deeper & deeper. My sons father is working in Metropolitan Trial Court Branch 42, Hall of Justice in Quezon City Hall Manila Philippines - he is a Sheriff in that Department. He always had have his alibis why he can't send any child support in a month & why he only sent Php 1,000 OR Php 1,500 & the maximum amount he can ever send is Php 2,000.
I am jobless... coz it's so difficult to be hired from the positions i am applying " OFFICE or small business firm(s) for Computer Secretary - Sales Representative - Receptionist office". I dont know why i am not lucky to have any paying jobs so i can support myself & my son & be able to pay our small place amounting Php2,000/month.
I also wish to apply and avail the benefits of a SOLO parents law. I just don't know if that law do exist here in Ozamiz City Misamis Occidental. Please help me with this atty. Thank you...

You have to refer your case to the public attorney's office of your place so they can give you assistance in filing a case for violation of RA 9262. SOLO Parent Act is effective all over the Philippines.
