Legal Question in Family Law in Philippines

My aunt died last 3 years ago,she left properties, no husband but he has an illegitimate son but not truly her son nor adopted. My mom and other sister's & brother's of my aunt and son of my aunt had an amicable settlement, they made an agreement of equal sharing,is it fair to the son of my aunt about the partition? what would be the proper or correct partition?
