i dont know what to do with my situation now, im an OFW in Saudi Arabia, a few month ago my wife filed a case against me (abandonment case) for not sending money for my 7 year old child with he, but all her statement is a lie. at meron po akong remittance document from westurn union as evidence, ang problema ko po di ko siya maasikaso dahil po sa nasa saudi po ako, kaya po two months ago nag karoon po ako ng warrant of arrest.

nag punta po ako ng embassy dito sa saudi at gumawa po ako ng affidavit na pinasisinungalingan ko po lahat ng bintang niya saakin, at gumawa rin po ako ng SPA para sa kapatid ko para maasikaso niya ang kaso ko kahit wala ako sa pilipinas, and tanong ko po atty. sa pag uwi ko po ng pilipinas sa susunod na buan, sa airport palang po ba huhulihin na ako? at pag nag pyansa na po ako at pinatuloy ang kaso, di po ba ako makakabalik ng saudi hanggat di pa tapos ang kaso? kahit may SPA abg kapatid ko,, please sir i realy need your advice kung ano ang gagawin ko, natatakot po ako umuwi baka di na po ako makabalik ng saudi at mawalan ako ng trabaho.

It is important that you engage a counsel of your own choice. Once you landed on Philippine soil the first thing that you should do is to post a bail in court. Thus, it is important that you should know the details of your case such as the criminal case number, the court branch and the amount of bail. If the court had forwarded the warrant of arrest to the Bureau of Immigration and Deportation (BID) then it is possible that you will be arrested. Tell your sibling (your brother or sister) to check in court.

As to the possibility of preventing you from leaving the country, that is only possible if upon motion of your wife the court had issued a hold departure order. In that case you cannot leave the country.

You can waive your appearance in court except during arraignment, promulgation and when the court requires your presence.

I suggest that you check whether you are on the watch list of the BID.
