Legal Question in Family Law in Philippines

Divorce

I am married to a USCitizen. He abandoned me after the wedding and went back to the US and cut all ties and communication with me. I tried to talk and get in touch with him but to no avail. He promised to file for my k3 visa, that did not happen. He went home recently but did not see me,instead he spend time with his (girl)friend who came home with him, later threatened me to keep quiet if i want to keep our marriage.I dont understand it.Why did he marry me in the first place only to hurt me this way.I am emotionally abuse as well as verbally abuse by his mom and that friend of him.I am in the Phils how can i get divorce? I cant self-petition myself to be non-immigrant and use my marriage to him.I need his support right?I was left in the dark why he is doing this. What will I tell the consular officer if i get tourist visa, they will think i am an intending immigrant still though I am not living with my husband and have abandoned me at all.I dont want to waste my time waiting for nothing. Can I file divorce if i go as tourist? What are my chances to get equal rights and alimony if i get divorce? Please help and tell me what is the best thing to do.Thank you.

Re: Divorce

You should file a petition to nullify your marriage on the ground of psychological incapacity because he abandoned you and has refused to perform the essential obligations of marriage. After that you can apply for a visitor's visa to the USA.

The best of luck to you.
