Evidences for Concubinage

Hi Attorney,

I would like to ask what is the most concrete evidence my sister can provide to sue for marital infedelity for his husband? Her husband has a mistress and even gave her a child. Now the mistress is on his 2nd pregnancy. Can you advise what is the first thing to do? He has 2 children on his wife and doesnt give any support. Please advise what are the appropriate charges we need to file against him. Thank you so much.

Well you can initiate a complaint for concubinage and for his failure to give support for violation of REPUBLIC ACT NO. 9262 known as violence against women and their children. Violence under the said law includes economic violence (as a result of your deprivatio of the support). As to the evidence for concubinage you can use the certificae of live birth of his love child with his mistress or you may engage a private investigator to gather the evidence. Concubinage is committed by a married man who is keeping a mistress in the conjugal dwelling or having sexual intercourse under scandalous circumstances with a woman not his wife. However, begin engaging a counsel of your own choice.
