legal separation/marriage to foreigner

i want to marry w/ foreigner but im still using my husband name. can i easily getmy legal separation fr my husband whom i separate for 7 yrs if we both agreed to have our own life.i want to ask the procedure and requirements needed for filling separation

You cannot enter into another marriage without first causing declaration of nullity of your existing marriage. A decree of legal separation is not enough.

It does not matter whether you and your husband agreed to live separate lives. You must have sufficient grounds to sue for declaration of nullity of marriage; otherwise, your petition will not be granted by the court.

Philippine law requires that you first cut off legally your marital relationship with your husband. Any private agreement is not allowed. It has to be coursed thru the legal process.
