The fact that you are separated from your husband does not affect your right for support. If you can prove the circumstances involving concubinage then you can file a criminal case for concubinage. The marital infidelity is easy to prove rather then the circumstances showing concubinage. Then in that case you can file a violation of RA 9262. The marital infidelity of your husband can be considered an act psychological violence and in case he deprives you and child of the support you need then that would be another count of violence known as economic under the said law. In short, you can file a civil case for support and\ criminal cases for concubinage and violation of RA 9262.
