Legal Question in Civil Litigation in Philippines
My married 35 year -old cousin is a seaman with a rank of a "Chief Mate". For 12 years of their married life, they were not blessed with even one offspring. Last late May 2012, he returned home and found out that his wife went with his family driver. Sources said, that the illicit affair had long happened already. It started just as when he entered his one-year contract with the overseas ship. The allotment that his wife received were all spent, mostly for that illicit affair.
He is now somewhat suicidal. Very down and so disgusted.
He now plans to file, Declaration of Nullity of their marriage. He forever abhors his dirty wife. Dirty in the sense, that she is used by another male and the like.
May I please have your legal advice or opinion of the matter, if his planned filing for Declaration of Nullity of Marriage would be the right thing he should do?
