Legal Question in Immigration Law in Philippines
My sister in California petitioned me in July 19, 1989 for an F4 immigrant visa. The petition according to the NVC was approved by the USCIS in Oct.6, 1989 when I inquired recently about the approval date by the USCIS. In April 20, 2010 we received a letter from the NVC that the petition was approved for processing and we submitted all documentations and paid all fees. We are now documentarily qualified according to the NVC. Our priority date will be in April 2013 as for March 2013 the NVC will be processing the July 15, 1989 F4 petition. Our two children were born in Oct. 7, 1985 and June 4, 1989 respectively. Can my children avail of the Child Status Protection Act (CSPA) as a derivative beneficiary of the F4 petition?
