Legal Question in Employment Law in Philippines
I am working in a private company. I got pregnant last year April 2010 and expected to deliver last January 1 or 2 2011. I was able to be given an advance money from my employer for my sss mat 1 benefit but when I delivered my baby last Dec. 29, 2010 they told me that sss disqualified me and that I have to pay for the advance payment that they had issued to me. I agreed that I will pay the amount by deducting into my salary until Dec. of this year. They asked me to make a letter saying that I will still pay the amount even if I resigned until December of this year and have it notarized. I resigned May 17, 2011 effective immediately since I need to take care of my son. The HR manager told me that I have to pay the amount today before I go home. Is it right though we already have the first agreement? She even shouted at me in front of the other HR staffs. She is a Korean

Why not inquire to the SSS whether you are indeed not qualified for the benefit. . Granting for the sake of argument that your agreement is valid ,your employer cannot coerce you into paying them immediately.
