Legal Question in Landlord & Tenant Law in Philippines
The tenant already paid one month advance as their reservation and filled out our reservation form and tenant's profile. In our reservation form which they signed, it stated there that "THE WHOLE RESERVATION AMOUNT WILL BE FORFEITED IN CASE THE TENANT DECIDE TO WITHDRAW OR BACK OUT, REGARDLESS OF GIVEN REASON." The following day tenant decided to withdraw because our street is flooded due to heavy rain. They reason out that we have not mentioned that our road is prone to flood. We refused to withdraw the money. Can they file a case against us. Your immediate reply will be highly appreciated.
