Legal Question in Product Liability in Philippines
Hi. this is my story, im selling my phone or to trade with a better phone. i have this ad and someone read it and sent me an email. he's selling his better phone to me which i want to have but he needs cash, so i told him that give me time to sell my phone for me to have the cash to buy his phone.. but he gave me deadline and when it came i told him that i haven't sell my phone yet. So i just told him that find another buyer. He gave me discount just to purchase his phone and another deadline because he said he wants to help me to buy his phone.. When the time comes, i told him again to find another buyer because i didn't have a buyer yet. He told me that he can sue me to court if i didn't pay him. He said that we had verbal agreement. is it true? what can i do? please give me advice. thanks

There is no perfected contract of sale so to speak.There is no meeting of the minds yet.The obligation is subject to a suspensive condition - when you obtain a buyer for your cellphone in order to raise some cash .Until such time that the condition has been fulfilled no obligation on your part to buy the said cellphone.
