Legal Question in Real Estate Law in Philippines
Good day! This is lovely from valenzuela. I just want to ask a help for my mother, last September 2011 my mother borrowed a money worth 6,000pesos from one of her friend's friend, with an interest of 1,200pesos monthly it has a contract and it is signed by notary public . The first three months my mother could give the interest of 1,200pesos monthly but starting January 2012 until Now april 2012 my mother cannot give the interest and she is asked me if I can help her situation then he told me the whole story. I was talked to the girl who was lend the money to my mother and asking for the interest to make it lower, I told her that I can give the primary amount of 6,000pesos and take out the interest from january to april since my mother already gave the 1,200 interest for 3months equivalent to 3,600pesos which is more than a half of my mother's loan and I think that's enough interest for seven months. She don't agree with my deal. And she insist that since she has the paper (the contract) she can use for the upper part of our house for three years which is the colateral of 6,000. My question is the paper or contract is enough to take advantage to use our 2nd level of our house? What if my mother don't have any source of money to give their asking interest? And isn't it 3 years staying to our house is too longer for just 6,000pesos? Please help me what should I do? I am very much appreciate with any reply. Thanks so much in advance! More power! God bless.

File a complaint for unjust vexation against that person in your barangay.Tell the whole story to the barangay officials that since you are already paying her she cannot take advantage of your mother.
