Legal Question in Real Estate Law in Philippines
good day! hi, i would just like to ask what we can do about our situation right now, we bought a house last jan 2008 for a total contract price of Php 990 000, we never missed any payment, now we have a total payment of around Php 660 000. now the problem is that the house is not built yet not even a single wall. they've promised us last 2009 that they are going to start the build the house 2nd quarter of the year, but until now they haven't started it and we can't get any direct answer when they are building the house. now we decided to tranfer our payments to a new unit ready for occupancy, but they said that only about Php 400 000 of are payments ony going to be credit to the new unit.. plss give advice. thanks

You have no choice but to ask for a refund of ALL the payments you made. This constitute an unsound reals estate business practice. File a criminal case for violation of Presidential Decree No. 957. This is to compel them to return the amounts you paid with interests.
