Legal Question in Real Estate Law in Philippines

hi.if a person has won a bid to purchase a lot and had paid only downpayment for it.then he will sell it.can he make a deed of assignment to the buyer even if the lot is not yet transferred to the seller? thank you for answers.

yes. what he is selling is the right of the seller.
