Declaratoria de Herederos
We are 9 brothers and sisters living here in the states and have inherited property in PR from our parents. We have a property appraisal, but little other documents showing wheather the property is registered. We wolud like to sell the property. What documents do we need and where can we get them? What legal form is needed from us as willing participants to sell the property? One of the hiers is decease with 2 siblings which we cant locate, can we still proceed with the sell?

You will need a full appraisal, initiate a "declaratoria de herederos" in the island and eventually, if all are in agreement, do a liquidation deed and sale deed before a notary public in Puerto Rico. For the declaratoria, a certified original copy of the birth certificate of all siblings, the defunction certificates of both parents, and a copy of any certification regarding how many offspring each parent had, if available.

You should first consult with a knowledgeable real estate attorney in your area. It may well be possible that this attorney may have to go through a lot of red tape regarding PR law to get you answer. If I can be of assistance, please free to give me a call. I may have a contact who can help.

Re: Declaratoria de Herederos
First of all, it is important to know if any of you or all of you are willing to come to Puerto Rico, or if you know someone you can trust in here to make him you attorney-in-fact by suscribing an special power of attorney. If somebody is you and your brothers attorney in fact in puerto rico you do not have even to come to sign a liquidation deed. If you want contact me by phone or email. Please feel free to leave a message if I am unable to answer you call.
