Legal Question in Family Law in Puerto Rico
found out hes not the father
Okay, so My fiance, Just found out after 5 years that his daughter is not his. She recently came to visit us in Georgia and something that he questioned became more evident when he saw her. He said alright i want to do a test. So he did and we found out when we went to take his daughter back to Puerto Rico. He spoke to the mother and she said '' okay, you dont have to pay anymore but i want you to be the father still''
But unfortunately he does not want any responsiblity to the child. He wants the girl to know her real father whoever he is. THe problem i think he is facing is, the little girl legally has his last name, and he signed the birth certificate. ( him and the mother were never married ). He doesn't want her to have his name. and he doesn't want to pay.
He doesn't want to live a lie he says. He sees his child about once a year.
they want another test. Which is fine( even though ours was accurate 100%) . But how can he protect himself from her demanding money( can she demand moneY) he doesn't pay legal child support he just gives her between 600-1000 every month. If everything were to go smoothly is it possible to remove his last name?
i just need to know what he can do? and what they can do?

Re: found out hes not the father
Under Puerto Rico law he had until twenty days to negate the recognition he made in the birh certificate or recant from it. If he failed to do so, then that daughter is his, forever, unless he can find who the real father is, initiate a filiation proceeding in local court and obtain the filiation decree.
