How do I get a sole custody of my 5 yr.old child?

I write this email to ask you of how do I get a sole custody of my 5 yr. old son? He is currently living with his father, my ex-boyfriend in Puerto Rico. To make my long story short, my ex-boyfriend had asked me if it would be okay for him to take my son for several months to Puerto Rico back in year 2000. We were already separated back then. Before he took him in yr. 2000; I have written up an affidavit that he needs to bring my son back after three months. It was notarized by a notary public. He called me up from Puerto Rico asking if it is possible to extend my son's stay in Puerto Rico because my ex-boyfriend enrolled himself to a University. He begged me for my son to stay because according to him, my son helps him focus with his studies. For several years I have tried to get my son back but he threatened me several times that he will not give my son back unless I get back with him. I don't want to go back with my ex-boyfriend. I tried to go there and talk to him to give my son back and he is manipulating me by using our son. I have been dealing with this situation for several years. I have been patient. I can't take it anymore. I would like to seek for a legal advise and I would like a lawyer to represent me.

If you had custody of your son, it might as well be a kidnapping case under federal law. You should be able to commence a custody case from your current state. Once a custody determination has been issued in the states the Department of Family usually executes it in Puerto Rico.
