Legal Question in Bankruptcy in Rhode Island
Bankruptcy, is it right for me?
Two years ago, I signed on with a debt settlement agency who did not inform me fully of their practices. At the time, I had approximately $43000.00 in debt. Now, because of interest and late/non-payment, I owe approximately $60000.00. I have a 2002 Toyota Camry that I still have a loan on and would like to keep as it is my ONLY means of transportation.
I have a court judgement against me from one of the credit cards, an arbitration judgement against me for an unsecured personal loan and another credit card that has been sent to collections. I do not own any property, as I was divorced in 2004 and our house was sold as part of the divorce. I am a single mom of 2 teenage children. I am temporarily out of work at this time due to a medical condition, but when I return to work, I will only be working my scheduled 20 hrs @ $15.50/hr. I also receive child support in the amount of $500.00/week. I know that I have screwed up my credit and I would like to know if I can save my car even if I file bankruptcy and if I could have the paperwork from the settlement agency reviewed to see if I have any legal recourse. You will need the help of an attorney admitted to practice in the bankruptcy courts in your home state (I'm in NY). The Rhode Island Bar Association can probably help you out with referrals, or you might see if you qualify for legal aid, which would provide free or low-cost legal help for you (call your county's Public Defender's Office or District Attorney's Office to get the phone number if you can't find the legal aid people in the phone book).
Bankruptcy is a way through your current difficulties; it may, in fact, be the only way through, but there are many factors to be considered that only an attorney who represents you would be able to go through with you.
