Legal Question in Criminal Law in Rhode Island
My boyfriend was jumped by 2 men at a restaurant in ri. he was injured and needed medical attention and prolonged physical therapy. can we sue the restaurant they also refused to call 911 and we had to go home and call ourselves

A restaurant does not necessarily have to ensure or guarantee the safety of its patrons; unless the restaurant causes or contributes to the assault (i.e. an employee assailant or drunk patron) The restaurant can be sued if there is a cause of action directly against it. For example if the men who jumped your boyfriend were drunk because the restaurant served them too much liquor. If the men simply knew your boyfriend and decided to jump him or there was a fight between your boyfriend and these two men the restaurant will not be responsible for this. Finally I am assuming this was a restaurant where food is served and not a nightclub. If it was a nightclub where bouncers were employed that is a different story.
