Legal Question in Criminal Law in Rhode Island
a friend was recently caught for shoplifting. before the police even arrived, the store made her sign a paper saying that she had to pay $500 dollars, in weekly sums of $25. Unfortunately she did sign that but what is the legality of that? can a store actually charge someone dollars and then also arrest them for the same crime and now she has to go to court.
1 Answer from Attorneys
The enforceability of any agreement she may have signed may be attacked if the store intimidated her into agreeing to pay a sum that bears no reasonable or rational relationship to any loss suffered by the store.
I suggest she find a good, local lawyer with whom she might build a relationship - many such lawyers would not charge at all to listen to her story and read whatever it is she signed, in order to accurately evaluate the situation.
