Legal Question in Family Law in Rhode Island

Adoption

My now adult son was adopted by my 2nd. husband around age 5.

He now wishes to get ''un-adopted'', and return to his original status, as in disolving the adoption, get his family name back etc.

What steps need to be taken by him to facilitate this transition.

Adoption took place in RI. where he still resides.

Thank you, IP

Re: Adoption

If your son is now an adult, he cannot get "un-adopted". Adoption proceedings relate to minors and how adults exercised their rights to obtain the adopted status under the laws in existence at that time. Once the age of majority is reached there is no longer a child to be adopted by another person or to get unadopted.

If the son wants to get his family name back, he can do so by filing a petition in the Rhode Island Probate Court for a name change in the Probate Court covering his city or town of residence in Rhode Island.

My best of luck to you. Feel free to have your son contact me if assistance is needed getting the name change.
