Re: child custody and visitation contempt in Rhode Island (RI)
You obviously did not provide enough information for me to assess your case. If you ex wife is not complying with custody or visitation orders you have the right to file a contempt motion in Family Court attempting to enforce the Court order. If she continues to violate court orders you could potentially move for a change of physical placement of the child.
If her contempt is found to be willfull there is a possibility that she could be incarcerated at the aci from day to day until she complies with the court orders. You really need to have a consultation with a Rhode Island(RI) Divorce and Family law lawyer / attorney.
Re: child custody
Your question is a bit unclear. Do you mean "custody" or do you mean "placement"? These are often confused. If you are not getting visitation you can file a motion to adjudge the mother of the child in contempt. If the court finds the contempt is willful after proof is provided of the direct violation of the court's order intentionally then the court could fine the mother, award attorneys' fees, award costs for lost time from work, or send the mother to the Adult Correctional Institution.
Without the Order and an examination of the circumstances, this is only general information. You may wish to check the articles at RIDivorceTips.com.
My best to you in this situation.
