Child Custody

I have been living with my daughter who is nearly 2 for a year and a half with out her father. He has paid no child support and we don't have a court order for custody. Is it ok if i take her on vacation to florida if he knows about it?

Under Rhode island (RI) family law,if there is no child custody order in effect and there is no contrary visitation order then either parent is free to take the child on vacations. If the parents have never been to Family Court and there are no family Court orders in effect then the parents automatically have joint custody of the minor child under RI law. Failure to pay child support is irrelevant under the facts stated. Please feel free to contact me or another attorney if you have any questions.
