can someone collect child support legally from a spouse without a divorce, just a separation?

Yes. In Rhode Island (RI) the custodial parent can legally obtain a Child Support order from the non custodial parent when the parties are just separated and not divorced. I suggest that you contact a Rhode Island Divorce, Family Law and Child Support Attorney / Lawyer.

A parent who has physical placement of the child as recognized by the Rhode Island Family Court may request an award of child support from the other natural parent of the child or from an adoptive parent if that is the case in any instance whether it be during a divorce proceeding, a separation proceeding or a miscellaneous action simply to establish child support.

The process may be delayed if the natural parent that you assert should be paying child support opts to protest paternity if the other natural parent is the alleged father of the child.
