Legal Question in Family Law in Rhode Island

child support medical coverage

My husband pays child support. He has the child covered under our medical insurance. The child's mother has not used this coverage in the last 8 yr. She uses her husbands. The child needs braces are we required under law to pay for them?

Re: child support medical coverage

what does the order say? If it is covered on your insurance, tell her so and refuse to pay unless it is submitted to available insurance. Otherwise, if uncovered (and probably is) most orders require the parties to share 50/50 in all uncovered expenses. some dispute with issue of whether dental is medical...a cheesie contention when the health and care of a child is at stake.
