You should speak to a Rhode Island (RI) Family law and Divorce attorney. If she is using illegal drugs such as cocaine or is abusing alcohol you could file an emergency motion for change of physical custody of the minor child. The Judge may order that her visitations with the child be supervised and may order her to get drug treatment. The judge may order her to get an immediate drug test with the Court drug testing program.

You could also be awarded sole custody of the minor child. Judges in the Rhode Island Family Court take drug use very seriously. I emphasize again that you need to contact a RI divorce Lawyer.
